The appellant lodged a cassation appeal against the February 21, 2003 decision of the Pretore of Leventina and asked for suspensive effect. The Camera di cassazione civile of the Tribunal of Appeal, by decree of 10 March 2003, granted the request under Art. 330 CPC and ordered that the appeal have suspensive effect. The decree was communicated to the Pretura of the Leventina District.
Art. 330 CPC; suspensive effect of a cassation appeal may be granted on request by the appellate court. Where the request is made in connection with a civil cassation appeal, the court decides incidentally on the provisional measure and may order suspension of the contested decision pending determination of the appeal.

Comunicazione alla Pretura del Distretto di Leventina.
