The President of the Ticino Chamber of Enforcement and Bankruptcy, acting as supervisory authority, decided on a request for suspensive effect attached to a complaint in debt-enforcement proceedings. The request was granted. The order further states that, until the complaint is decided, enforcement acts and measures may still be carried out. Notification to the parties was to be made through the competent enforcement and/or bankruptcy office.
Art. 36 LEF, 10 and 24a LPR; suspensive effect in supervisory complaints: the supervisory authority may grant suspensive effect on request, but may at the same time regulate the continuation of enforcement measures pending the complaint. The order is interim and limited to the procedural protection requested; it does not decide the merits of the complaint (consid. implicit).

Al ricorso è concesso effetto sospensivo.
