The president of the Ticino debt-enforcement and bankruptcy chamber, acting as supervisory authority, decided a complaint accompanied by a request for suspensive effect. The request was formally granted. However, the order also states that, until the complaint is decided, enforcement acts and measures may continue. Notification to the parties was ordered through the competent enforcement/bankruptcy office.

Regest

Art. 36 LEF; Art. 10 and 24a LPR: suspension of enforcement pending complaint proceedings. The supervisory authority may grant suspensive effect to a complaint, yet may frame the order so that execution acts and measures remain permissible until the complaint is decided. The operative scope of the stay must therefore be derived from the dispositif as a whole and may be limited by express reservations (consid. only operative order).

Il presidente della Camera di esecuzione e fallimenti quale autorità di vigilanza

visto il ricorso annesso;

preso atto della domanda volta all'ottenimento dell'effetto sospensivo;

richiamati gli art. 36 LEF, 10 e 24a LPR

ordina:

  1. Al ricorso è concesso effetto sospensivo.

  2. Fino alla decisione sul ricorso si può procedere ad atti e misure esecutivi.

  3. Notificazione alle parti con il ricorso a cura dell'organo d'esecuzione e/o fallimento competente.
