A supervisory complaint in debt enforcement was filed in German. The appellant was ordered to translate it into Italian, but did not comply within ten days. Meanwhile, the enforcement office struck the complaint from its docket. The appellate supervisory chamber therefore held that the proceeding had become moot and ordered it removed from the rolls. It further decided that no court fees would be charged and no indemnities would be awarded. An appeal to the Federal Tribunal was indicated within ten days.
Art. 7 cpv. 2 LPR; language of the complaint in supervisory debt-enforcement proceedings; if a complaint is not filed in Italian and the ordered translation is not submitted within the set time limit, the authority may not proceed on that filing. Where the underlying matter is removed from the docket by the enforcement office, the supervisory proceeding becomes devoid of object and is struck off the rolls. In such proceedings, the fee-free regime under Art. 20a cpv. 1 LEF and Art. 61 cpv. 2 lett. a OTLEF applies, with no indemnities under Art. 62 cpv. 2 OTLEF (consid. implicit).

l’operato dell’ Ufficio di esecuzione e fallimenti di Bellinzona
ritenuto che giusta l’art. 7 cpv. 2 LPR l’atto di ricorso deve essere presentato in lingua italiana;
che il termine di dieci giorni impartito al ricorrente il 28 giugno 2001 per tradurre il ricorso, redatto in lingua tedesca, è decorso infruttuoso;
preso atto che in data 8 agosto 2001 l’UEF di Bellinzona ha stralciato dai ruoli il ricorso;
considerato come la procedura sia così divenuta priva di oggetto;
atteso che – benché la gratuità della procedura sia contraria al sistema di diritto amministrativo in cui si muove il ricorso secondo l'art. 17 LEF (Jean–François Poudret/Suzette Sandoz–Monod, Commentaire de la loi fédérale d'organisation judiciaire, vol. II, Berna 1990, n. 2.10 all'art. 81, p. 804) – siffatto principio è stato codificato per espressa volontà del legislatore (art. 20a cpv. 1 primo periodo LEF e 61 cpv. 2 lett. a OTLEF; DTF 125 III 383 cons. 2a). Per lo stesso motivo non si assegnano indennità (art. 62 cpv. 2 OTLEF);
richiamati gli art. 20a cpv. 1 primo periodo LEF, 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF;
pronuncia:
La procedura di cui all’inc. 15.01.224 è stralciata dai ruoli poiché divenuta priva di oggetto.
Non si prelevano tasse, né si assegnano indennità.
Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
