In a debt enforcement supervisory appeal before the Ticino Court of Appeal’s enforcement and bankruptcy chamber, the appellant withdrew the appeal by letter of 16 August 2000. Art. 20a cpv. 1 LEF; art. 61 cpv. 2 lett. a and art. 62 cpv. 2 OTLEF: where the complainant withdraws the supervisory appeal, the proceedings lose their object and are to be struck from the docket. In such a case, absent special reasons, no court costs or party indemnities are levied. The decision is final in the sense that it concerns only the procedural termination of the appeal and not the merits of the enforcement measure.
