A supervisory complaint against the Leventina debt enforcement office for delayed justice was withdrawn by the complainant before the decision. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal therefore struck the complaint from the docket as moot. It further ordered that no costs be charged and no indemnities be awarded.
Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; withdrawal of a supervisory complaint and consequences for costs. Where the complainant withdraws the complaint, the proceeding loses its object and is struck from the docket. In such a case, absent special circumstances, no costs are levied and no indemnities are awarded.
