A supervisory complaint in a debt enforcement matter was withdrawn after the parties reached an amicable settlement. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal held that the complaint had become moot and ordered it struck from the register. It also decided that no court costs would be collected and no indemnity would be granted. Suspensive effect had previously been ordered by presidential decree.
Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; a supervisory complaint becomes without object when the complainant withdraws it following an amicable settlement between the parties, so that it is to be struck out of the register. In such a situation, the supervisory authority may dispense with court costs and indemnities. The continuation of the proceeding is excluded once the dispute has lost its object (consid. 1).

contro l’operato dell’ Ufficio di esecuzione e fallimenti di Locarno nell'esecuzione n. __________ promossa contro il reclamante dalla
richiamato il decreto presidenziale 24 novembre 1994 di concessione dell’effetto sospensivo;
preso atto che con scritto 27 gennaio 1995 il patrocinatore del reclamante ha ritirato il reclamo, avendo le parti regolato bonalmente i loro rapporti;
considerato come il gravame sia divenuto così privo d’oggetto;
richiamati gli art. 67 cpv. 2 e 68 cpv. 2 OTLEF
DECRETA:
Il reclamo 23 novembre 1994 di __________, è stralciato dai ruoli ai sensi dei considerandi.
Non si prelevano spese e non si assegnano indennità.
