The president of the bankruptcy chamber of the Ticino Court of Appeal dealt with an appeal against a 10 July 2003 Lugano district court decision and a request for suspensive effect. The appeal was granted only partially. The court ordered the Lugano bankruptcy office to draw up the inventory of assets and to annotate the restriction on the appellant’s power to dispose of real estate. The order was based on Arts. 174 and 170 LEF.

The appellate judge may grant suspensive effect only to the extent justified by the circumstances and may preserve specific protective bankruptcy measures notwithstanding the appeal. In particular, interim measures aimed at safeguarding the estate, such as inventorying assets and annotating a restriction on the disposal of immovable property, may remain in force where full suspension is not warranted (consid. implicit).

la decisione 10 luglio 2003 del Pretore del Distretto di Lugano, sezione 5 nella procedura promossa da
vista la domanda di effetto sospensivo contenuta nell’appello
richiamati gli art. 174 e 170 LEF
decreta 1. Al ricorso è accordato effetto sospensivo parziale.
L’Ufficio fallimenti del Distretto di Lugano, via al Fiume 7, 6962 Viganello, allestirà l’inventario dei beni e provvederà all’annotazione della restrizione della facoltà di disporre dei beni immobili dell’appellante.
