The Ticino Court of Appeal, Enforcement and Bankruptcy Chamber, dealt with an appeal against a bankruptcy ruling. The appellant had been ordered to pay an advance of CHF 120, with a warning that failure to do so would make the appeal inadmissible. The deadline passed without payment. The court therefore struck the appeal from the roll and, because partial suspensive effect had previously been granted, declared the bankruptcy again from the stated time. Costs of CHF 50 were imposed on the appellant.
Art. 36 LEF, 174 LEF; failure to pay the advance on appeal costs within the fixed time-limit after express warning justifies striking the appeal from the roll. Where a partial suspensive effect had been granted in bankruptcy appeal proceedings, the strike-out of the appeal entails that the bankruptcy must again be declared effective from the time fixed by the court (consid. 2). The procedural consequence is independent of the merits of the appeal and follows from the lapse of the appeal due to noncompliance with the advance order.

ritenuto che, essendo con ordinanza 11 aprile 2003 stato concesso all’appello effetto sospensivo parziale, con l’odierna decisione di stralcio va nuovamente dichiarato il fallimento (cfr.
