The Ticino Court of Appeal, Bankruptcy and Debt Enforcement Chamber, held that an appeal against a bankruptcy declaration had become moot because a subsequent separate bankruptcy proceeding against the same debtor had already ended with a bankruptcy judgment. The court therefore struck the appeal from the docket. It ordered the appellant to bear the CHF 50 court fee already advanced and directed that the CHF 85 excess be returned to the Leventina debt enforcement office acting as bankruptcy administrator.
Bankruptcy appeal; mootness after subsequent bankruptcy judgment; costs. Where, during the pendency of an appeal against a bankruptcy declaration, a later final judgment in another bankruptcy proceeding concerning the same debtor has already declared the debtor bankrupt, the appeal loses its object and is to be struck from the docket. In such a situation, the appellate costs are borne by the appellant, and any surplus advance is to be refunded to the competent debt enforcement office acting as bankruptcy administrator (consid. 1-2).

preso atto che in un'ulteriore procedura fallimentare promossa nei confronti della __________ questa Camera con sentenza 10 maggio 2000 ha respinto l'appello presentato dalla __________ (cfr. Inc. CEF 14.2000.45 in re __________), dichiarandone il fallimento;
ritenuto come la presente procedura sia così divenuta priva d'oggetto, per cui va stralciata dai ruoli;

Whether the appeal against the bankruptcy declaration should still be decided after a later bankruptcy judgment involving the same debtor.
The appeal had become devoid of object and was struck from the docket.
Because a later decision in another bankruptcy proceeding had already declared the respondent bankrupt, there was no remaining practical interest in deciding the present appeal.
How to allocate the appellate court fee and excess payment after the appeal was struck out.
The court fee of CHF 50 remained at the appellant's expense, and the excess CHF 85 was to be refunded to the Leventina debt enforcement office as bankruptcy administrator.
Since the proceeding was terminated as moot, costs were allocated against the appellant and any surplus advance was ordered returned to the competent office.
