The Chamber of enforcement and bankruptcy of the Court of Appeal dealt with an appeal against a decision of the Pretore of Locarno-Città. After having ordered the appellant to pay an advance for expected court costs by 13 July 1998 and warned that non-payment would lead to striking out under Art. 312 CPC, the President found that payment was made only on 15 July 1998. Holding the deadline to be peremptory, the court struck the appeal from the roll and ordered the appellant to pay CHF 50 in court costs.
Art. 312 CPC; late payment of the advance for procedural costs results in striking out the appeal if the court-fixed deadline is peremptory and the warning of non-entry/desertion was duly given. The decisive criterion is the timeliness of payment, not the eventual payment itself. Once the deadline has expired without payment, the appellate remedy is not examined on the merits and the appellant bears the costs of the proceedings (consid. on peremptory character and tardiness).

la decisione 15 giugno 1998 del Pretore di Locarno-Città nella causa promossa contro l'appellante da
richiamata la diffida 23 giugno 1998 del Presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 13 luglio 1998 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 390.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 15 luglio 1998 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 19 giugno 1998 di ____________________avverso la decisione 15 giugno 1998 del Pretore di Locarno- Città , è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
