The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal filed by AP 1 against a decision of the Pretore of Lugano. After the presiding judge set a deadline for an advance on costs and warned that failure to pay would cause the appeal to be deemed deserted under Art. 312 CPC, the appellant paid only on 3 October 2006, one day after expiry. The court held the deadline to be peremptory, struck the appeal from the roll, and charged the appellant CHF 100 in costs.

Where the appellate court sets a peremptory time limit for payment of the advance and expressly warns that failure to comply will entail dismissal of the appeal, payment after expiry is untimely; the appeal is therefore struck out as deserted (consid. 1). The peremptory character of the deadline excludes reinstatement absent a timely payment within the prescribed period. Court costs follow the outcome and may be charged to the appellant (consid. 2).

richiamata la diffida 7 settembre 2006 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 2 ottobre 2006 per effettuare sul c.c.p. 69–10370–9 del Tribunale d’appello –introiti AGITI– un deposito di fr. 1400.– a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 3 ottobre 2006 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 4 settembre 2006 di AP 1 avverso la decisione 7 agosto 2006 del Pretore del Distretto di Lugano, sezione 3, è stralciato dai ruoli per versamento tardivo dell'anticipo.
