APPE1 appealed against the Lugano District Pretore’s decision of 28 July 2004. The president of the Second Civil Chamber of the Court of Appeal ordered an advance on costs of CHF 500 payable by 6 October 2004, with a warning that the appeal would be declared deserted under Art. 312 CPC if payment was not made in time. The advance was paid only on 13 October 2004. Holding the deadline to be peremptory, the court struck the appeal from the docket and imposed CHF 50 in court costs on the appellant.
Art. 312 CPC; late payment of the advance on costs in appeal proceedings. Where the appellate court sets a peremptory deadline for payment of the advance on costs and expressly warns that non-compliance will result in dismissal/striking off, payment after expiry of the deadline is untimely and leads to removal of the appeal from the docket. The decisive point is the expiry of the fixed term, not the subsequent payment; the sanction follows irrespective of the merits of the appeal (consid. 1). Costs of the discontinued appeal are borne by the appellant (consid. 2).

richiamata la diffida 13 settembre 2004 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 6 ottobre 2004 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di
fr. 500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 13 ottobre 2004 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 6 settembre 2004 di APPE1 avverso la decisione 27 luglio 2004 del Pretore del Distretto di Lugano, sezione 1, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
