The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a Pretore decision from Locarno-Campagna. After ordering an advance on costs of CHF 1,500 and warning that non-payment by 9 December 2002 would cause the appeal to be struck out, the appellant paid only on 10 December 2002. The court held the deadline to be peremptory and the payment therefore late. The appeal was removed from the docket, and the appellant was ordered to pay CHF 50 in court costs.

The decisive point is the peremptory nature of the court-imposed deadline; once expired, subsequent payment does not cure the default (consid. implicit). Costs of the aborted appeal are charged to the appellant.

richiamata la diffida 21 novembre 2002 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 9 dicembre 2002 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 1'500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 10 dicembre 2002, come risulta dalla copia della polizza di versamento annessa all'estratto conto corrente postale del Tribunale d'appello del 12 dicembre 2002 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 18 novembre 2002 di __________, avverso la decisione 25 ottobre 2002 del Pretore della giurisdizione di Locarno-Campagna, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
