The parties settled an appeal concerning precautionary measures (bank account freeze and seizure of documents) and also the merits of the dispute. On that basis, the Second Civil Chamber of the Ticino Court of Appeal struck the appeal from the docket. The court ordered that the CHF 100 in court fees and expenses, already advanced by the appellants, remain at their charge, while party costs were compensated. The lower court was notified of the striking-off order.
Settlement during appeal; striking off the proceedings. Where the parties resolve the dispute pendente lite, including the merits and the provisional measures sought, the appellate court may strike the appeal from the roll. In such a case, costs may be allocated to the appellants and party costs compensated, depending on the settlement and the procedural posture (consid. 1-2).

Appellanti i convenuti i quali, con appello 19 settembre 2002, hanno chiesto la riforma del primo giudizio nel senso di respingere l'istanza di controparte mentre quest'ultima, con osservazioni 24 ottobre 2002, ha postulato la reiezione dell'appello.
Ed ora sullo stralcio della procedura d'appello avendo le parti risolto, in via transattiva, la controversia, non solo per quanto è delle chieste misure cautelari, ma anche nel merito e meglio come al verbale di stralcio 19 dicembre 2002, ed al relativo allegato, della Pretura di Lugano.
