The appellant challenged an order requiring him to post security for costs under Art. 153 CPC. While the appeal was pending, the Pretore struck the merits case from the roll because the parties had reached an extrajudicial settlement. The Court of Appeal held that the appeal had therefore lost its object and ordered the appellate proceedings removed from the docket. No fees or expenses were levied.
Art. 153 CPC; appeal against an order for security for costs becomes moot once the underlying merits proceedings are terminated by extrajudicial settlement and struck off the roll. In such a situation the appellate court no longer has a live dispute to decide and must remove the appeal from the docket. Where the proceedings are rendered moot for that reason, no court fees or costs are charged (consid. implicit).

Preso atto della pronuncia 8 agosto 2001 del Pretore che ha provveduto -su istanza
dell' attore- allo stralcio della causa di merito dai ruoli essendo le parti addivenute ad un
accordo transattivo extragiudiziale.
Considerato come, di conseguenza, la procedura d'appello riguardante la cauzione giudiziale sia divenuta priva d'oggetto,
decreta 1. La procedura davanti alla seconda Camera civile a dipendenza dell'atto di appello 25 aprile 2001 di __________ , è stralciata dai ruoli.
Non si prelevano tasse e spese.
