The Second Civil Chamber of the Ticino Court of Appeal struck an appeal from the roll after the Pretore reported that the merits case had been removed from the docket because the parties concluded an extrajudicial settlement. Since the underlying dispute no longer existed, the challenge to the order requiring security under Art. 153 CPC had become moot. The court ordered no fees or costs.
Mootness of appeal after settlement; where the merits proceedings are removed from the roll following an extrajudicial settlement, an appeal directed solely against an ancillary order loses its object and is struck from the docket. In such a situation, the appellate court may dispense with the collection of judicial costs (consid. on mootness and cost allocation).

Preso atto della pronuncia 8 agosto 2001 del Pretore che ha provveduto -su istanza
dell' attore- allo stralcio della causa di merito dai ruoli essendo le parti addivenute ad un
accordo transattivo extragiudiziale.
Considerato come, di conseguenza, la procedura d'appello riguardante la cauzione giudiziale sia divenuta priva d'oggetto,
decreta 1. La procedura davanti alla seconda Camera civile a dipendenza dell'atto di appello 25 aprile 2001 di __________ , è stralciata dai ruoli.
Non si prelevano tasse e spese.
