The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against an eviction judgment of the Pretura of Locarno-Città. After the President had granted suspensive effect, the appellants' counsel informed the court that the appeal was withdrawn because the parties had reached an extrajudicial settlement. The court held that the appeal had therefore become moot and struck it from the docket. It ordered the appellants to pay the court fee and costs of CHF 50 jointly and severally.
Appeal proceedings; withdrawal of the appeal after an out-of-court settlement renders the appeal moot and leads to removal from the docket; the appellate court may then allocate costs to the appellants, here jointly and severally, notwithstanding the absence of a merits decision.
