The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a Bellinzona District Court decision. The court president had ordered the appellant to pay a CHF 1,500 advance on costs by 3 July 2000, warning that the appeal would be deemed deserted if payment was not made in time. The amount was paid only on 11 July 2000. Holding the deadline to be peremptory, the court struck the appeal from the docket and charged the appellant CHF 50 in court costs.
Art. 312 CPC; late payment of an advance on costs after expiry of a peremptory deadline results in the appeal being treated as deserted and struck from the docket. Where the court expressly warns of the consequence of non-payment within the fixed term, payment after expiry cannot cure the default (consid. implied by the order). The consequence is procedural inadmissibility without examination of the merits, with court costs charged to the defaulting appellant.

richiamata la diffida 15 giugno 2000 del presidente di questa Camera mediante la quale alla ricorrente veniva assegnato un termine scadente il 3 luglio 2000 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 1500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo l'11 luglio 2000 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 13 giugno 2000 di __________, avverso la decisione del Pretore di Bellinzona, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
