Sintesi

The applicant sought a declaration of enforceability for an arbitral award dated 11 August 1998. The Second Civil Chamber of the Ticino Court of Appeal noted that all parties had signed declarations accepting the award and waiving any nullity appeal. vista l'istanza 9 settembre 1998 presentata dall’avv. __________ chiedente che il lodo di cui entro sia dichiarato esecutivo;

preso atto delle dichiarazioni sottoscritte da tutte le parti mediante le quali esse dichiarano di accettare il lodo arbitrale e pertanto di rinunciare ad interporre ricorso per nullità (cfr. doc. C. D e E).

visto l’art. 3 lett. g) e l’art. 44 dello stesso concordato, nonché l’art. 2 del decreto legislativo concernente l’adesione del Cantone Ticino al concordato intercantonale sull’arbitrato,

dichiara che il lodo 11 agosto 1998 prolato dall’arbitro unico avv. __________ nella procedura vertente fra __________ é esecutivo.
