ricordato che il 4 luglio 2002 l'appellante è stata invitata dalla presidente di questa Camera a depositare entro il 22 luglio 2002, a titolo di anticipo per le spese giudiziarie presunte, la somma di fr. 300.– sul conto corrente postale 69-10370-9 del Tribunale d'appello, introiti agiti, con l'avvertenza che, decorso infruttuoso il termine, l'appello sarebbe stato stralciato dai ruoli (art. 312 cpv. 2 CPC);

accertato che il termine, prorogato dalle ferie giudiziarie (dal 15 luglio al 15 agosto 2002) è decorso infruttuoso;

ritenuto che nelle circostanze descritte l'appello non può essere esaminato nel merito;

considerato che gli oneri processuali vanno a carico di chi li ha provocati, ma che la tassa di giustizia va adeguatamente ridotta, la procedura di appello terminando senza sentenza (art. 21 LTG);

stabilito che non si giustifica di attribuire ripetibili alla controparte, cui l'appello non è nemmeno stato intimato;

richiamato l'art. 12 cpv. 1 e 2 LTG,

decreta: 1. L'appello del 28 giugno 2002 è stralciato dai ruoli per mancato versamento dell'anticipo.
