Sintesi

The appellants appealed against a first-instance decision declining jurisdiction over a succession renunciation matter, then withdrew the appeal before service. The First Civil Chamber of the Ticino Court of Appeal therefore struck the case from the roll. Citing the general rule that a withdrawing party bears the unnecessary costs it caused, the court nevertheless made an exception because the appeal had not been served and the judicial costs were minimal. It ordered that no court fees or costs be charged and no compensation be awarded.

Art. 352 cpv. 1 e 2 CPC; withdrawal of appeal and allocation of costs. Where the appellant withdraws the appeal, the appellate court removes the cause from the roll. As a rule, the withdrawing party bears the costs unnecessarily caused thereby; exceptionally, however, the court may waive costs where the procedural posture shows that the appeal had not yet been served and the incurred expenses are negligible. In the absence of opposing parties, no party compensation is awarded (consid. 1-2).

premesso che con decisione del 25 luglio 2001 il Pretore del Distretto di Lugano, sezione 4, ha accertato la propria incompetenza a statuire sulla rinuncia di __________ e __________ __________ alla successione del figlio __________ __________ (____________________1966 – __________ __________ 2001), cittadino italiano deceduto a __________, suo ultimo domicilio;

accertato che contro tale decisione gli istanti hanno presentato appello il 6 agosto 2001;

preso atto che con lettera del 21 agosto 2001 essi dichiarano di ritirare l'appello;

ricordato che in linea di principio chi recede dalla lite deve sopportare le tasse e le spese da lui inutilmente cagionate (Rep. 1990 pag. 284, 1978 pag. 375 seg.);

stabilito nondimeno che nella fattispecie l'appello non è stato oggetto di intimazione, sicché le spese giudiziarie sono minime;

considerato, ciò posto, che si giustifica di prescindere – eccezionalmente – dal prelievo di spese, mentre non vi sono controparti cui assegnare ripetibili;

richiamato l'art. 352 cpv. 1 e 2 CPC,

decreta: 1. La causa è stralciata dai ruoli per desistenza.

  1. Non si riscuotono tasse o spese né si assegnano ripetibili.

  2. Intimazione all'avv. dott. __________ __________, __________.
