In a neighbor dispute over the height of a thuja hedge, the defendant appealed the Lugano District Court judgment ordering him to reduce the hedge to 1.25 m. Before the appellate court, he withdrew the appeal after the parties reached an agreement. The First Civil Chamber of the Ticino Court of Appeal treated the withdrawal as desistance, struck the case from the docket, and considered the appellant to be the losing party. Because the parties agreed to set off their party compensation, the court only allocated reduced judicial costs, totaling CHF 150, to the appellant.
Art. 352 cpv. 1 and 2 CPC; withdrawal of an appeal and procedural costs: the withdrawal of an appeal is to be treated as desistance, with the withdrawing appellant deemed to be the losing party. Where the proceedings end without a merits judgment and the parties demonstrate good faith, the court may reduce the judicial fee in an appropriate manner under Art. 21 LTG. If the parties agree on compensation for party costs, such costs may be set off by agreement, notwithstanding the allocation of court costs.

premesso che con sentenza dell'11 dicembre 1998 il Pretore del Distretto di Lugano, sezione 3, ha ordinato a __________ __________ di ridurre l'altezza della siepe di tuja posta sulla sua proprietà fino a 1.25 m;
constatato che contro tale sentenza il convenuto ha presentato un appello del 18 gennaio 1999 in cui ha chiesto di respingere la petizione;
preso atto che con lettera del 30 novembre 2000 l'appellante ha dichiarato di ritirare il ricorso per intervenuto accordo fra le parti;
ricordato che il ritiro dell'appello equivale a desistenza (Rep. 1978 pag. 375), sicché l'interessato va ritenuto soccombente;
accertato che le parti hanno concordato di compensare le ripetibili;
considerato, in ogni modo, che la tassa di giustizia deve essere adeguatamente ridotta per tenere conto della buona volontà dimostrata dalle parti, la causa non terminando con un giudizio di merito (art. 21 LTG);
richiamato l'art. 352 cpv. 1 e 2 CPC,
decreta: 1. La causa è stralciata dai ruoli per desistenza.
