The President of the Pretura penale in Bellinzona dealt with a withdrawn opposition against a criminal summary penalty order. Applying Arts. 210 and 211 CPP, the court struck the proceedings from the docket and declared the decree d'accusa enforceable. Upon withdrawal of an opposition, the criminal objection proceedings are to be struck off ex officio and the summary penalty order becomes enforceable. The court may order the file returned to the competent authority. In the absence of a justice fee, the procedural expenses may be charged to the objecting party, as follows from the court’s cost allocation under the applicable procedural rules.
