The President of the Criminal Court in Bellinzona dealt with an objection to a criminal accusation decree. After the complainant withdrew the complaint by letter of 10 May 2004, the court struck the proceedings from the docket and returned the file to the competent authority. It also ordered that no fees or costs be levied.
Art. 31 cpv. 1 and Art. 144 cpv. 1 CP; withdrawal of the complaint: where the private complaint is withdrawn, the criminal proceedings are to be struck off the rolls and the file returned to the competent authority. In such a procedural termination, the court may order that no fees or expenses be charged.
