The President of the Pretura penale noted that the objection against the criminal penalty order had been withdrawn on 2 March 2004. He therefore struck the proceeding from the docket, declared the penalty order enforceable, and sent the file back to the competent authority. No justice fee was levied, but the costs of the decision, fixed at CHF 30, were charged to the objector.
Art. 210-211 CPP; withdrawal of an objection against a penalty order: upon withdrawal, the objection proceedings become moot and are struck from the docket; the penalty order acquires enforceability. Procedural costs may be charged to the objector, while the justice fee may be waived (consid. implicit).
