The Bellinzona Pretura penale dealt with an objection to penal order no. DA 2876/2004. Before the scheduled public hearing, the defence withdrew the objection by letter of 18 October 2004. The judge therefore struck the case from the roll, held that the penal order became enforceable, cancelled the hearing, and returned the file to the issuing authority. Court costs of CHF 80 were imposed on the objector.
Art. 210-211 CPP; withdrawal of an objection to a penal order: once the objection is validly withdrawn, the court shall strike the matter from the roll, the penal order acquires legal force and enforceability, and the scheduled hearing becomes moot. The file is returned to the issuing authority for the continuation of the matter within its competence. The objecting party may be charged with the court fee and the costs occasioned by the decision (consid. implicit).

interposta al decreto d'accusa n. DA 2876/2004 di data 26 agosto 2004 del AINQ 1
preso atto del ritiro della suddetta opposizione con lettera 18 ottobre 2004 del difensore;
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 18 gennaio 2004 alle ore 14:30 non avrà quindi luogo; l'incarto è ritornato al AINQ 1 per quanto di sua competenza.
La tassa di giustizia di fr. 50.00 e le spese relative alla presente decisione sono a carico dell'opponente.
