preso atto del ritiro della suddetta opposizione con lettera
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 14 dicembre 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al AINQ 1 per quanto di sua competenza.
La tassa di giustizia di fr. 50.00 e le spese relative alla presente decisione sono a carico dell'opponente.
