The Pretura penale noted that the accused withdrew the opposition to penal decree DA 937/2004 at the hearing of 1 December 2004. Applying Arts. 210 and 211 CPP, the judge struck the case from the roll and declared the penal decree enforceable. No fees or costs were charged.
Arts. 210-211 CPP; withdrawal of opposition to a penal decree. If the opposition is withdrawn during the hearing, the criminal objection proceedings become devoid of object and are struck from the roll; the penal decree acquires enforceability. In such a situation, the court may dispense with the collection of judicial costs and expenses (consid. implicit).

ACCU 1 ,
interposta al decreto d'accusa n. DA 937/2004 di data 18 marzo 2004 del AINQ 1
preso atto del ritiro della suddetta opposizione con dichiarazione resa durante il dibattimento del 1. dicembre 2004;
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
L'incarto è ritornato al AINQ 1 per quanto di sua competenza.
Non si prelevano né tasse né spese per la presente decisione.
