The Bellinzona Pretura penale dealt with an objection to penal order no. DA 1716/2004. Before the court decided, the accused, through counsel, withdrew the objection in writing. Applying Art. 210 para. 3 CPP, the court struck the proceeding from the docket and declared the penal order enforceable. considerato che con scritto 3/8 novembre 2004 l'accusato,per il tramite del proprio difensore, ha dichiarato di ritirare la suddetta opposizione;
richiamato l'art. 210 cpv. 3 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
§ l'incarto è ritornato al AINQ 1 per quanto di sua competenza.
La tassa di giustizia di fr. 30.-- e le spese in complessivi fr.30.-- relative al presente procedimento sono a carico dell'opponente.
