The accused had lodged an opposition against criminal decree DA 1311/2004, but withdrew it by letter of 2 June 2004. The President of the Pretura penale therefore struck the case from the rolls, held that the decree became enforceable, and returned the file to the issuing authority for further action. No justice fee was levied, but CHF 30 in costs for the decision were imposed on the opponent.
Arts. 210-211 CPP; withdrawal of opposition against a criminal decree: upon valid withdrawal, the objection proceedings are terminated by striking the matter from the docket and the decree of accusation becomes enforceable. The file is returned to the issuing authority for execution or further competence. Costs of the discontinuance decision may be charged to the opponent; no justice fee need be collected if the court so orders.

decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
L'incarto è ritornato al _AINQ1 per quanto di sua competenza.
Non si preleva tassa di giustizia; le spese di fr. 30.-- relative alla presente decisione sono a carico dell'opponente.
