The opponent withdrew the objection to summary criminal decree no. DA 1336/2004. The Pretura penale, sitting in Bellinzona before Judge Giovanni Celio, noted the withdrawal, struck the proceedings from the docket, declared the decree enforceable, cancelled the already scheduled public hearing, and sent the file back to the prosecutor for further action. The opponent was ordered to pay CHF 30 in court fees and the costs of the decision, for a total of CHF 80.

preso atto del ritiro della suddetta opposizione con lettera 24 novembre 2004;
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 25 novembre 2004 alle ore 09:15 non avrà quindi luogo; l'incarto è ritornato al _AINQ1 per quanto di sua competenza.
La tassa di giustizia di fr. 30..-- e le spese relative alla presente decisione sono a carico dell'opponente.
