The President of the Criminal Court dealt with the withdrawal of an objection to a criminal penalty order. The court struck the proceedings from the docket, held that the penalty order became enforceable, and returned the file to the competent authority. It waived the justice fee, but ordered the objecting party to bear the costs of the decision, set at CHF 30.
Arts. 210-211 CPP; withdrawal of objection against a criminal penalty order: upon valid withdrawal, the objection proceedings are terminated, the case is struck from the docket, and the penalty order becomes enforceable. The court may regulate costs separately, including waiving the justice fee while charging the procedural costs to the objecting party.
