The President of the Pretura penale in Bellinzona struck off the criminal proceeding after noting the withdrawal of the complaint. Art. 31 cpv. 1 and Art. 123 cifra 1 CP; withdrawal of the complaint renders the criminal objection proceedings without object and justifies striking the case off the roll. In such a situation the court may order the file returned to the competent authority and, absent contrary reasons, waive the collection of court fees and costs.
