The President of the Pretura penale in Bellinzona noted that the opponent had withdrawn his objection to a penal decree by letter of 24 November 2003. The court therefore struck the case from the roll, declared the penal decree enforceable, and returned the file to the substitute public prosecutor Andrea Pagani. No justice fee was charged, but CHF 30 in costs for the decision were imposed on the opponent.
Art. 210–211 CPP; withdrawal of an opposition to a penal decree: once the objection is validly withdrawn, the court strikes the opposition proceedings from the roll and the penal decree becomes enforceable. The file is returned to the prosecuting authority for further execution or any other matters within its competence. Procedural costs of the decision may be charged to the objecting party; the court may dispense with a justice fee while nevertheless allocating specific decision costs to the opponent (consid. 1–2).
