The Pretura penale in Bellinzona struck the case from the docket after the complainant withdrew the complaint in writing at the hearing. The order concerned an objection to a summary penalty order. The court ordered no taxes or costs to be levied and returned the file for any further action within its competence.
Art. 31 cpv. 1 CP; withdrawal of a complaint in a prosecution dependent on a complaint leads to discontinuance of the proceedings. Once the complainant validly withdraws the complaint, the criminal basis for continuing the case falls away and the court may strike the matter from the docket. Where the order so provides, no court fees or costs are charged.
