In an objection proceeding before the Pretura penale, the accused signed a statement acknowledging that his telephone remark could have been misunderstood and expressing regret. On that basis, the complainant, through counsel, withdrew the criminal complaint. The judge therefore struck the case from the docket and ordered that no court fees or justice costs be charged. The file was returned to the substitute public prosecutor for any further action within her competence.

Richiamata l'opposizione 21 ottobre 2003 di
interposta al decreto d’accusa n. DA / di data __________ 2003 del
considerato che in data 12 marzo 2004, il prevenuto ha sottoscritto di proprio pugno la seguente dichiarazione di cui al relativo verbale del dibattimento:
“Io sottoscritto __________ __________ dichiaro che nel corso della conversazione telefonica a carattere professionale, intercorsa con il sig. __________ __________ in data 21 maggio 2003, ho pronunciato nei confronti di quest’ultimo una frase che poteva essere male interpretata. Non intendevo in alcun modo offendere
l’onore di __________ __________ e tantomeno affermare che questi avesse gonfiato fatture o fatturato prestazioni non dovute. Sono dispiaciuto per quanto accaduto.”
che, stante quanto precede, il querelante, e, per esso, il suo patrocinatore, ha dichiarato di ritirare la querela penale del 26 maggio 2003;
richiamato l’art. 31 CPS;
decreta: 1. Il procedimento è stralciato dai ruoli.
§ L’incarto è ritornato al Sost. Procuratore Pubblico Monica Casalinuovo per quanto di sua competenza.
Non si percepiscono né tasse, né spese di giustizia.
