The accused filed an opposition to a criminal decree of accusation, then withdrew it in writing before the scheduled public hearing. The Pretura penale therefore struck the case from the docket, held that the decree of accusation became enforceable, cancelled the hearing set for 30 January 2004, and returned the file to the public prosecutor. The opponent was ordered to pay CHF 50 in court fees and CHF 30 in expenses.
Art. 210 CPP; withdrawal of opposition to a criminal decree of accusation: when the accused validly withdraws the opposition, the court strikes the objection proceedings from the roll, the decree of accusation becomes enforceable, and any scheduled public hearing falls away. interposta al decreto d’accusa n. DA / di data 13 ottobre 2003 del
considerato che con suo scritto 22 gennaio 2004, il prevenuto ha dichiarato di ritirare l’opposizione interposta al predetto decreto d’accusa;
richiamato l’art. 210 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
2.Il pubblico dibattimento, già fissato per il 30 gennaio 2004 alle ore 14:30 non avrà quindi luogo. L'incarto è ritornato al procuratore pubblico per quanto di sua competenza.
La tassa di giustizia di Fr. 50.- e le spese in complessivi Fr. 30.- relative alla presente decisione sono a carico dell'opponente.
