The Criminal Court of Bellinzona struck the case from the roll after noting that the complainant had withdrawn the complaint. The opposition to the decree of accusation therefore no longer required adjudication on the merits. The file was returned to the public prosecutor for any remaining matters within his competence. The court ordered that no fees or costs be levied.
Art. 31 cpv. 1 and Art. 177 CPS; effect of withdrawal of complaint in criminal proceedings: where the injured party validly withdraws the complaint, the criminal proceedings become devoid of object and are struck off the roll. The court then confines itself to taking note of the withdrawal and, if necessary, returning the file to the public prosecutor for further action within his competence; absent special reasons, no fees or costs are levied.
