The criminal objection was withdrawn by counsel before the scheduled public hearing. The President of the Pretura penale therefore struck the proceedings from the roll, declared the summary penal order enforceable, and cancelled the hearing. The objector was ordered to pay CHF 50 court fee and CHF 30 expenses, for a total of CHF 80.

Arts. 210-211 CPP; withdrawal of an objection against a decreto d'accusa renders the objection proceedings moot and justifies striking the case from the roll. Upon withdrawal, the hearing is cancelled and the summary penal order becomes enforceable. The procedural costs of the discontinuance may be charged to the objector; cost allocation follows the termination caused by the withdrawal (consid. 1-3).
