The opponent withdrew his objection to a penal decree through counsel. The Pretura penale therefore struck the case from the docket, declared the penal decree of 2 December 2002 enforceable, canceled the scheduled public hearing, and sent the file back to the public prosecutor for any further action within his competence. Court fees of CHF 50 and related costs were imposed on the opponent.
Arts. 210-211 CPP; withdrawal of the objection against a penal decree. Upon valid withdrawal of the objection, the objection proceedings are discontinued and struck from the docket; the penal decree becomes enforceable. Any already fixed public hearing is rendered unnecessary. The objecting party bears the judicial fee and procedural costs occasioned by the decision.
