The objection filed against a criminal decree of accusation was withdrawn by the objecting party. The President of the Pretura penale therefore struck the proceedings from the docket, declared the decree of accusation enforceable, and returned the file to the Public Prosecutor for any further action within his competence. The court also ordered that no fees or costs be levied.
Arts. 210–211 CPP; withdrawal of the objection against a decree of accusation: upon valid withdrawal, the objection proceedings are discontinued and the decree of accusation becomes enforceable. The court merely records the termination of the contestation and returns the file to the public prosecutor for execution or further measures within competence; no costs are charged where the decision so provides.
