The opponent withdrew his opposition to a penal decree by letter of 14 November 2003. The President of the Pretura penale therefore struck the proceedings from the docket, declared the penal decree enforceable, cancelled the already scheduled public hearing of 27 November 2003, and returned the file to the public prosecutor for further action. Court fees of CHF 50 and related costs were imposed on the opponent, for a total of CHF 80 in the cost statement.
Arts. 210-211 CPP; withdrawal of opposition to a penal decree: once the opposition is withdrawn, the court must strike the proceedings from the docket and the decree becomes enforceable. Any already fixed hearing is cancelled and the opponent bears the procedural costs, unless a different allocation follows from the law; see consid. 1-3.
