The Pretura penale dealt with the accused's declaration of appeal against a conviction for embezzlement. Although the written judgment was served on 27 January 2004, no statement of grounds was filed within the 20-day statutory period. The president therefore declared the appeal lapsed and the judgment final. The court also ordered that no fees or costs be charged.
Art. 289 cpv. 2 CPP; failure to file the appeal statement of reasons within the statutory time limit after service of the written judgment results in lapse of the appeal and finality of the first-instance judgment. Where the appeal is declared lapsed, the court may order that no costs be levied, if so decided in the decree.

ritenuto che con sentenza 8 gennaio 2004 il Signor __________ __________ è stato dichiarato autore colpevole di appropriazione indebita,
l'accusato è stat condannato alla pena di 3 (tre) mesi di detenzione, sospesi condizionalmente per un periodo di prova di 2 anni, nonché al pagamento delle tasse e spese giudiziarie di complessivi fr.1'050.-;
l'accusato con scritto 12 gennaio 2004 ha inoltrato dichiarazione di ricorso;
la sentenza motivata è stata intimata alle parti in data 27 gennaio 2004;
entro il termine legale di 20 giorni dall'intimazione della sentenza scritta (art. 289 cpv. 2 CPP) non è stata presentata la motivazione del ricorso;
decreta: 1. Il ricorso dell'accusato _________ ___________ è decaduto e la sentenza è definitiva.
Non si prelevano né tasse né spese.
