The President of the Pretura penale in Bellinzona dealt with an opposition to a criminal decree of accusation. After the objecting party withdrew the opposition by letter, the court struck the matter from the register and declared the decree of accusation enforceable. It also ordered that no fees or costs be charged. The file was returned to the substitute public prosecutor for any further action within his competence.

Upon valid withdrawal of the opposition, the court removes the case from the register and the decree of accusation acquires enforceability. In such a procedural situation, the court may also decide that no court fees or costs are levied (consid. implicit).
