The opponent withdrew the opposition to a criminal decree of accusation. The Pretura penale of Bellinzona therefore struck the case from the roll, declared the decree enforceable, and cancelled the public hearing already scheduled. The court also imposed justice fees and judicial costs totalling CHF 50 on the opponent.
Art. 210 cpv. 3 CPP; withdrawal of opposition against a decree of accusation: the withdrawal terminates the opposition procedure, so that the case is to be struck from the roll and the decree of accusation becomes final and enforceable; the scheduled public hearing falls away, and the procedural costs may be charged to the opponent according to the order of the court.
