The President of the Pretura penale noted that the accused had filed opposition to decree of accusation DA 2537/2003 but later withdrew it. Applying Arts. 210 and 211 CPP, the court struck the case from the docket and declared the decree enforceable. No judicial fee was collected, but the costs of the decision, fixed at CHF 30, were imposed on the objecting party. The decision was issued by President Marco Kraushaar in Bellinzona.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: where the objecting party withdraws the opposition, the criminal proceedings are removed from the roll and the decree of accusation becomes enforceable.
