The defendant filed an objection to a criminal decree of accusation, then withdrew it through counsel. The Pretura penale therefore struck the proceedings from the docket, held that the decree of accusation became enforceable, cancelled the scheduled public hearing, and sent the file back to the public prosecutor for further handling. The opponent was ordered to pay the court fee of CHF 50 and the costs of the decision, totaling CHF 80 according to the attached cost statement.

Art. 210-211 CPP; withdrawal of objection against a decree of accusation. Where the objecting party withdraws the objection, the court strikes the objection proceedings from the roll, the decree of accusation acquires executory force, and the scheduled hearing lapses. Procedural costs may be charged to the objecting party as the unsuccessful procedural participant (consid. 1-3).
