The President of the Pretura penale noted the withdrawal of the opposition filed against a summary penalty order. On that basis, the court struck the case from the roll, cancelled the already scheduled public hearing, and declared the summary penalty order enforceable. The opponent was ordered to pay CHF 50 in court fees and CHF 30 in expenses, for a total of CHF 80.
Arts. 210-211 CPP; withdrawal of opposition against a summary penalty order. Upon valid withdrawal of the opposition, the objection proceedings are discontinued and the summary penalty order becomes enforceable; any already fixed hearing is vacated. Procedural costs may be charged to the opponent in accordance with the ordinary cost rules applicable to the discontinuation of the proceedings.

preso atto del ritiro della suddetta opposizione con lettera 30 gennaio 2004,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 10 marzo 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al per quanto di sua competenza.
La tassa di giustizia di fr. 50.00 e le spese relative alla presente decisione sono a carico dell'opponente.
