After a criminal complaint had been opposed to a decree of accusation, the parties reached a settlement on 2004-04-23 before the judge of the Pretura penale. The settlement included withdrawal of the criminal complaint filed on 2003-02-21. The judge therefore struck the case from the docket under Art. 31 CPS and charged the respondent with a justice fee of CHF 20 plus costs of CHF 30.
Art. 31 CPS; withdrawal of the criminal complaint after a settlement reached before the criminal judge justifies striking the proceedings from the docket. Where the case is terminated in this manner, the court may allocate the justice fee and expenses to the respondent as ordered in the dispositive part.

considerato che in data 23 aprile 2004 le parti, con la mediazione dello scrivente Giudice, sono addivenute ad un accordo transattivo che ha comportato, fra l’altro, il ritiro della querela penale 21 febbraio 2003;
in applicazione dell’art. 31 CPS;
decreta: 1. Il procedimento è stralciato dai ruoli.
§ L'incarto è ritornato al per quanto di sua competenza.
La tassa di giustizia in Fr. 20.- (venti) e le spese per complessivi Fr. 30.- (trenta) sono a carico del querelato.
